These Terms and Conditions contain disclaimers of warranties and liability limitations. Please read carefully before accessing the Website. Accessing or using this Website implies acceptance of these Terms and Conditions, even if you choose not to read them. Preamble.


By accessing and using this Website, whose domain name is rocatell.com, owned by ROCATELL GROUP LLC (hereinafter “ROCATELL”), the User is accepting the Terms and Conditions of use contained in this agreement and expressly declares their acceptance using electronic means, in terms of the provisions of Article 1803 of the Federal Civil Code.

If you do not fully and completely accept the Terms and Conditions of this agreement, you should refrain from accessing, using, and observing the Website. If you access, use, and observe the Website, it will be considered as absolute and express acceptance of the Terms and Conditions of use stipulated here.

The mere use of the Website grants the general public the status of User (referred to as the “User”) and implies full and unconditional acceptance of all the general and specific conditions included in these Terms and Conditions of use published by ROCATELL at the very moment the User accesses the Website.

For the purposes of this agreement, the Parties agree that the User shall be any person of any nature who enters the Website and/or any of the subpages displaying its content and/or the person of any nature who uses any of the services offered through said page.

In all cases, the User will be responsible for the veracity of the information provided to ROCATELL. ROCATELL may at any time and when deemed appropriate, without the need to notify the User, make corrections, additions, improvements, or modifications to the content, presentation, information, services, areas, databases, and other elements of the Website, without this giving rise to any claim or compensation, nor implying acknowledgment of any responsibility in favor of the User.

Agreement Modifications.


ROCATELL reserves the right to modify the Terms and Conditions of use of this agreement at any time, with such modifications becoming effective immediately through the publication of the modified agreement on the Website.

Thus, the User agrees to periodically review this agreement to stay informed of such modifications. Notwithstanding the foregoing, each time the User accesses the Website, it will be considered an absolute acceptance of the modifications to this agreement.

Additional Terms.


Occasionally, ROCATELL may add provisions to the Terms and Conditions of use of this agreement related to specific areas or new services provided on or through the Website (hereinafter "Additional Terms"), which will be published in the specific areas or new services of said site for their reading and acceptance. The User acknowledges and accepts that these Additional Terms form an integral part of this agreement for all legal purposes.

Survival.


These Terms and Conditions of use, as well as the Additional Terms, constitute the entire agreement between the Parties and supersede any other agreement or arrangement previously entered into. Any clause or provision of this agreement, as well as the Additional Terms, legally declared invalid, will be eliminated or modified at ROCATELL's discretion to correct its defect or flaw. However, the rest of the clauses or provisions will maintain their force, obligation, and validity.

Locality.


Recognizing the global nature of the Internet, the User must comply with all local rules regarding online conduct and content. The User must also comply with all applicable laws regarding the transmission of technical data from Mexico or the country in which they reside. Additionally, it is the User's responsibility to comply with the conditions in which applicable laws, rules, or regulations restrict certain online activities.

Non-Waiver of Rights.


The inactivity of ROCATELL, its affiliates, or suppliers in exercising any right or action derived from this agreement shall not be interpreted as a waiver of such rights or actions at any time.

Applicable Law and Jurisdiction.


This agreement will be subject to and interpreted in accordance with the laws and before the courts of Mexico City, Mexico, without regard to conflict of laws principles. You irrevocably submit to the non-exclusive jurisdiction of the courts located in Mexico. You agree that the provisions of the United Nations Convention on Contracts for the International Sale of Goods will not apply. If any provision of this document is held by a court of competent jurisdiction to be invalid, it will be severed, and the remaining provisions will remain in full force without being invalidated in any way. The Parties are independent contractors. These Terms and Conditions are not intended to create a partnership, joint venture, or agency relationship between the Parties. Except for written agreements with ROCATELL that expressly reference these Terms and Conditions, this is the complete agreement between you and ROCATELL concerning the matters contained herein and will not be modified except in writing by ROCATELL.

ROCATELL reserves the right to cancel your account for violating any of these Terms and Conditions at any time without prior notice.
